Terms of sale

1. Purpose and scope

These terms of sale govern the provision of Kovant services by [operating entity legal name] (“Kovant”) to its customers, both businesses and consumers. Placing an order implies unreserved acceptance of these terms.

2. Description of services

Kovant offers seventeen service lines across five categories:

  • Hosting — websites, Discord bots, game servers, privacy frontends, Nextcloud, Coolify PaaS.
  • Managed services — website creation, IT management and support, security administration, growth and marketing.
  • Security — security software, server hardening, EDR/XDR and automation, SOC/MDR.
  • Training — automate your company, upskill yourself.

3. Pricing

Prices are displayed in euros on the site, exclusive of VAT (“excl. VAT”) by default for businesses and inclusive of VAT (“incl. VAT”) for consumers. Subscriptions are monthly or annual (annual offering the equivalent of two months free); project work is a fixed fee. No hourly billing is applied. The applicable amounts are those published on the service page at the time of the order.

4. Ordering, payment and invoicing

Orders are placed online. Payment is processed by our provider Stripe. The invoice is issued and made available in the client area. The “Suite” discount applies automatically when several paid lines are bundled on a single contract.

5. Term, renewal and termination

Subscriptions run for the chosen term (monthly or annual) and renew by tacit renewal, unless terminated within the notice conditions stated on the service page. Termination is done from the client area or by email.

6. Right of withdrawal (consumers)

Consumers have a fourteen (14) day period to exercise their right of withdrawal (Article L221-18 of the French Consumer Code). However, for digital services performed immediately, the consumer expressly consents to immediate performance and waives the right of withdrawal (explicit tick-box at order), in accordance with Article L221-28 of the French Consumer Code.

7. SLA and contractual guarantees

Kovant commits by contract to:

  • Uptime of 99.9% on the services concerned, credited if missed per the credit schedule stated on the service page.
  • Performance: LCP < 2s, INP < 200ms, CLS < 0.1 on the pages we manage.
  • Accessibility: WCAG 2.2 AA compliance.
  • Bilingual support FR + EN, with contractual first-response times.

Penalties take the form of invoice credits, within the limits set by each service’s SLA.

8. Statutory guarantees

Consumers benefit from the statutory guarantees of conformity and hidden defects under the conditions provided by law.

9. Data reversibility and portability

On termination, your data is returned to you in open formats, exportable at any time during the term of the contract. Data is deleted thirty (30) days after the end of the contract, subject to statutory retention periods (for example, invoices).

10. Liability and force majeure

Kovant’s liability is limited to direct and foreseeable damages. Kovant cannot be held liable in the event of force majeure or of an act attributable to the customer or a third party.

11. Training-specific conditions

Training is invoiced to your company, with materials included. Eligibility, funding, cancellation conditions and the training rules of procedure are communicated before enrolment.

12. Mediation, governing law and jurisdiction

In the event of a dispute, consumers may use consumer mediation (see the legal notice) and the European online dispute-resolution platform. These terms are governed by French law.
